Please read carefully. By purchasing
goods from the online trade shop, you accept these terms and conditions:
It is a key policy of our Company to provide a standard of product and service that will make it a pleasure for you to deal with us, so that you will want to deal with us again and also recommend us to your colleagues. We do our best to deal with all matters in an enlightened and friendly way, and if you take the same approach with us, then in practice we are likely to provide a higher level of service and support than these Terms and Conditions require. Do please bear this in mind when dealing with us.
i. "The Goods" shall mean the items or products supplied.
ii. "The Company" shall mean Puretone Ltd.
iii. "The Customer" shall mean the person or Company placing an order or to whom the Goods and/or services are supplied or to whom the Goods are hired.
iv. If any of the terms or provisions of the Customerís order are inconsistent with these terms and conditions, then they shall not be part of the Contract between the Customer and the Company and shall not be binding on the Company.
Prices and Payment
i. Prices in insert pricelists are exclusive of VAT and postage costs. The Company reserves the right not to accept an order, and shall not be required to give any reason for so doing.
ii. Quotations are valid for 90 days from date of issue.
iii. Should credit terms be agreed, the Companyís standard credit terms are payment within 30 days of the date of issue of invoice. Should all or any part of an invoice remain unpaid after 30 days, the Company reserves the right to charge interest on the unpaid amount at the rate specified on the invoice.
iv. The Company reserves the right to suspend deliveries and the right to cancel orders where payment for any order, related or otherwise, has not been made by the due date.
v. In the event of late previous payment by the Customer, the Company reserves the right to accept subsequent orders only on the basis of pro forma invoices.
vi. In the event of cancellation of an order by the Customer, the Customer shall be liable for all costs incurred by the Company on that order, including loss of profit, which cannot be recovered by sale of the Goods to other customers.
vii. Prices and data herein may be subject to change without prior notice. E&OE.
While every effort will be made to deliver on or before the dates agreed (if any), any dates given are estimates only. No guarantee of delivery dates can be given, and time shall not be of the essence of the Contract for delivery.
The Company send all UK deliveries FREE via Standard Delivery postage. Larger orders will be dispatched by a receipted courier service. Your delivery will normally be delivered to your door next day, failing that please allow 2-5 working days, once the payment has cleared. Postage costs are calculated by the location of delivery address. For some items, special delivery arrangements may be needed, and therefore postage costs may vary from those shown at the checkout. Items with special delivery arrangements are shown in the item description. The Company accepts no liability for loss or damage arising to late or non-delivery. Availability: Placing an order on the Puretone Trade Online Shop does not guarantee that the item is currently in stock. In the case of an item being currently out of stock, we will contact you within 48 hours to advise a likely delivery date, or an alternative product.
All UK Orders - FREE Postage
Any order placed on the Puretone Online Trade Shop that are shipped to a UK address will receive FREE Standard Delivery postage. You will also have the option of upgrading to Express Delivery if you require your items urgently.
All orders between £200.00 - £499.99 - 5% DISCOUNT + FREE Postage (UK Only)
Any order placed on the Puretone Online Trade Shop that has a subtotal between £200.00 and £499.99 (before tax) will receive a 5% discount. This will be automatically calculated and shown at the checkout.
All orders over £500 - 10% DISCOUNT + FREE Postage (UK Only)
Any order placed on the Puretone Online Trade Shop that has a subtotal over £500.00 (before tax) will receive a 10% discount. This will be automatically calculated and shown at the checkout.
Title and Risk
i. Ownership shall pass to the Customer only on receipt by the Company of the full invoice price of the Goods. In the event of the Companyís terms of payment not being met, or of any circumstances which may lead to the appointment of a receiver or liquidator by the Customer before payment has been received, the Customer shall allow the Company access to enter the Customerís premises for the purpose of recovery of the Goods.
ii. Risk in the Goods shall pass to the Customer on arrival of the Goods at the delivery address of the Customer.
Health and Safety
It shall be the Customerís responsibility to ensure that the Goods are used according to the instructions provided, and also to ensure that they are used in a generally safe and responsible manner by appropriately qualified and experienced personnel.
i. The Company guarantees at its discretion to repair or replace free of charge any Goods of its own manufacture found to its satisfaction to be defective due to faulty design, materials or workmanship within 12 months or the stated warranty period, provided that the Goods have been operated and maintained as recommended by the Company.
ii. For Goods supplied but not manufactured by the Company, the guarantee shall be the same as that given to the Company, by the supplier. Please note that certain items from other suppliers, such as bulbs, have a limited operating life and a consequently shorter warranty period.
iii. The Company accepts no responsibility for incidental or consequential damages.
iv. Delivery of all items returned to the Company for repair or replacement shall be paid for by the Customer.
v. It shall be the responsibility of the Customer to insure the Goods against any loss or damage while they are away from the Customerís premises.
The Company shall not be responsible or liable for its failure to perform its obligation if such failure is beyond the control of the Company, whether caused by acts of God, unavailability or shortage of components or energy necessary to produce or deliver the Goods by usual modes of transportation, fire, flood, war, embargo, strikes, labour disputes, explosions, riots, regulations, acts of terrorism , restriction or orders of any governmental authority, or any other cause, beyond the Control of the Company or its suppliers.
Arbitration in the event of any dispute not settled by the parties shall be submitted in London in accordance with and subject to the provisions of the Arbitration Act (1950) (or any amendment or re-enactment thereof) currently in accordance with English Law including statute Law.
Should purchased Goods not meet with the Customers expectations and the Customer wishes to return it the Company will refund (less postage) based on the table below Goods that are returned in their original packaging and in pristine condition. To assist the Company in handling returns correctly, please package all returns carefully and send with a covering letter. The Company reserves the right to decline the return of any product of a personal nature should there be (in the Companyís sole judgement) an unacceptable hygiene or health and safety risk. Custom shell modifications are free of charge on all models within 120 days of despatch with the exception of the AQ System (60 days). All earmoulds are guaranteed for 30 days from date of despatch. The Company will remake/modify free of charge (at the Companyís discretion) in the event of poor fit the same style/type of earmould. In the case of an alternative earmould being required this will be charged at current list price. Special order and custom products can only be returned at the Companyís discretion.
(*) Only RIC devices may be returned for credit. Receivers are non-returnable if used or the packaging seal has been broken.
(#) £30 (Ä39) restocking charge per arm if the arms have been cut or altered. (+) Accessory products are subject to a re-stocking charge at the Companyís discretion.
Returns Postage and Pre-Paid Labels
Please note it is the responsibility of the Customer to incur the postage charge for Goods returned for any reason other than being faulty. Any Goods returned using a pre-paid address label for any reason other than listed on the label, or without prior approval, will result in the Customerís account being charged.
